Some states do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you in full. In such states, our liability shall be limited to the greatest extent permitted by law.

TO THE FULL EXTENT PERMITTED BY LAW, (A) NO ARBITRATION OR PROCEEDING SHALL BE JOINED WITH ANY OTHER; (B) THERE IS NO RIGHT OR AUTHORITY FOR ANY DISPUTE TO BE ARBITRATED OR RESOLVED ON A CLASS ACTION BASIS OR TO UTILIZE CLASS ACTION PROCEDURES; AND (C) THERE IS NO RIGHT OR AUTHORITY FOR ANY DISPUTE TO BE BROUGHT IN A PURPORTED REPRESENTATIVE CAPACITY ON BEHALF OF THE GENERAL PUBLIC OR ANY OTHER PERSONS.

11.3 Exceptions to Arbitration

Notwithstanding the above, either party may seek emergency injunctive relief or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration. Nothing in this Section shall prevent East Coast Wings from pursuing claims for unpaid amounts owed to us through any available legal means, including small claims court.
